Terms of Service

BriskApply is operated by Ninja Solutions, LLC, a Wyoming limited liability company.

Ninja Solutions, LLC 30 N Gould St, Ste R Sheridan, WY 82801 Contact: info@applyscout.io

What BriskApply does

We read job postings from public career pages and application systems, match them against the profile you build, complete the employer's form with your answers, and submit it from your own email address.

We are not an employer, a recruiter, a staffing agency, or your agent, and we are not affiliated with, endorsed by, or acting for any employer or applicant tracking system. We are not a law firm and nothing here is legal advice.

Your account

One account belongs to one person. Keep your sign-in secure, and tell us straight away if someone else gets into it. You are responsible for everything done through your account. You must be at least 18 and able to enter a binding contract to use BriskApply.

What you are authorising

You give us permission to complete and send applications in your name, from your email address, using the information you provide. Checking an application before it goes out is available on every plan, and the setting is yours to change at any time.

An application submitted through BriskApply is your statement to that employer. The employer will read it as something you said, and so will we. Submitting confirms that the information is true and complete, in the same way it would if you had typed it yourself.

Some application systems require an account with the employer before you can apply. If a feature you turn on handles this, you authorise us to create or use that account in your name, under your email address, for the applications you send, and to accept that system's terms where accepting them is a condition of applying. Any account created this way is yours.

We do not contact employers other than by submitting their form. We do not negotiate, follow up, chase, withdraw, or reply to anyone for you.

How we fill answers

BriskApply is built so that tailoring only reorders and rephrases material that is already in your resume, and a mechanical check runs on every tailored document against introducing a company, title, date, or credential that was not there.

Where an answer has no source in what you gave us, we leave it blank or select the safest truthful option, and the receipt records which. Generated, derived, and inferred answers are our best reading of your information, not verified facts about you, and you are responsible for reviewing what goes out under your name. You can check every application before it sends, on any plan.

Automated submissions and your responsibility

BriskApply is a tool you direct. You choose which roles to apply to, you supply the information, and each application is completed and submitted at your instruction and in your name. You confirm that you are permitted to apply for the roles you queue, that you are legally authorised to work where a role requires it, and that you are permitted to use an automated tool to complete and submit applications on your own behalf.

Some employers and application systems set their own terms about automated access. Using BriskApply to apply is a choice you make and a risk you accept, and you are responsible for your own compliance with those terms. We are not your agent, and we do not warrant that any submission complies with a third party's terms or that a third party will accept it.

You are solely responsible for the truth and completeness of everything submitted under your name, including any answer we generated, derived, or inferred that you did not change before it was sent.

What we do not promise

This is the part to read closely. We provide the sending, not the outcome.

We do not promise interviews, replies, offers, or that any application improves your chances. We do not promise that a posting is genuine, current, accurately described, or still open, or that the employer will read what was sent, or that their system accepted it in the form we sent it.

We do not promise that matching will surface every suitable role or exclude unsuitable ones, that an inferred answer is the right answer for your circumstances, or that an application sends within any particular time.

Employer forms change without notice, and third-party systems go down. We do not promise the service will be available, uninterrupted, or error free, and we may change, limit, suspend, or withdraw any part of it.

To the fullest extent the law allows, BriskApply is provided as it is and as available, with no warranties of any kind, whether express, implied, or statutory. That includes any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

Some places do not allow warranties to be excluded. Where that is so, this section applies only as far as it can, and nothing here removes a right you hold that cannot be removed.

Your content

Your resume, answers, and writing samples stay yours. You give us only the permission we need to run the service for you: to store them, format them, tailor them to a posting, and submit them to employers you queue.

We will not sell your information, share it for advertising, publish it, show it to another user, or use your resume, answers, or writing samples to train models for anyone else. You confirm that what you upload is yours to upload and is accurate.

Trial

Your trial is free and needs no card. We ask for a card only if you choose to subscribe.

The trial ends at 20 applications or 7 days, whichever comes first. It does not charge you and it does not convert on its own: to keep applying after it ends, you subscribe to a paid plan. You are never charged during the trial, and never charged at all without adding a card yourself. Free trials are limited per network, so we may decline to start one where we detect too many from the same place; you can still subscribe.

Plans and billing

Starter is $29 a month for 100 applications and up to 10 a day. Standard is $59 for 300 and up to 25 a day. Pro is $89 for 600 and up to 50 a day. Plans bill monthly in advance and renew automatically until you cancel. Prices are exclusive of tax where tax applies.

Your purchase is sold and processed by Paddle.com, our authorised reseller and Merchant of Record. Paddle, not BriskApply, is the seller and merchant of record for the transaction: it takes payment, charges and remits any tax, issues your invoice, and handles billing disputes and chargebacks. Your purchase is also subject to Paddle's buyer terms and privacy notice, and for the payment transaction those terms govern where they differ from these. We may change the processor we use, and if we do, the current one is named at checkout.

Credit packs are sold at your plan's per-application rate: $0.30 on Starter, $0.20 on Standard, $0.15 on Pro, in packs of 50, 150 and 400. Credits are only spent once the day's allowance is gone, the oldest pack is always used first, and a pack expires three months after purchase.

Moving to a larger plan takes effect immediately. We charge the difference for the rest of the current period, prorated, and the larger allowance is available straight away. Moving to a smaller plan takes effect at your next billing date, so the allowance you have already paid for stays available until then, and the smaller price applies from that date. You can undo a pending change by selecting your current plan again before the date arrives. Unused credits carry over either way. Cancelling stops the next charge and leaves access open until the end of the period you have paid for.

Refunds are covered by our Refund Policy, which forms part of these terms.

We can change prices with at least 30 days notice by email, and the new price applies from your next renewal. If a payment fails or is reversed we can suspend sending until it is settled.

What you may not do

Do not use BriskApply to submit information you know to be untrue, to apply on behalf of someone else, to apply for work you are not permitted to do, to get around the daily caps, to scrape or resell job data, or to interfere with the service or the systems we submit to. We can suspend or close an account that does, without refund.

Third parties

Postings, forms, and application systems belong to third parties. We do not control them and we are not responsible for what they contain, how they handle a submission, what they decide, or what they do with your information once it reaches them.

Ending your account

You can cancel your subscription at any time from the account screen. To close your account or have us delete the personal information we hold about you, write to info@applyscout.io, and we will do so within the time the law requires. Receipts and billing records are kept afterwards as described in the Privacy Policy, because the law and our own records require it.

We can suspend or end an account that breaks these terms, that we reasonably believe is being used fraudulently, or where continuing would expose us to legal risk.

Liability

Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Beyond that, and to the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential loss, and not for lost earnings, lost opportunity, a role you did not get, a rejection, or reputational harm.

Where we are liable, our total liability for all claims in any twelve month period is limited to the amount you paid us in the twelve months before the claim arose, or $100, whichever is greater.

You will defend, indemnify, and hold harmless BriskApply, Ninja Solutions LLC, and our members, officers, contractors, and providers from and against any claim, demand, loss, liability, and reasonable cost, including legal fees, arising out of or related to: information you gave us being untrue, inaccurate, or incomplete; any application submitted under your name; your use of the service in breach of these terms or in breach of any employer's or application system's terms; material you uploaded or the rights in it; or your violation of any law or of anyone's rights. We may assume the exclusive defence and control of any such matter, in which case you will cooperate with us, and you will not settle any claim in a way that imposes any obligation on us without our prior written consent.

Disputes and arbitration

Please read this section carefully. It affects how claims between you and us are resolved, and it requires most disputes to be resolved by individual arbitration rather than in court.

Informal resolution first. If something goes wrong, write to info@applyscout.io with the details. Most things are settled that way. You and we agree to try in good faith to resolve any dispute informally for at least 30 days before starting a formal proceeding, and completing that period is a precondition to starting arbitration.

Agreement to arbitrate. If we cannot resolve it, you and we agree that any dispute, claim, or controversy arising out of or relating to these terms or the service, including its formation, interpretation, performance, breach, and termination, will be resolved by binding individual arbitration and not in a court. This agreement is governed by the Federal Arbitration Act.

Delegation. The arbitrator, and not any court, has exclusive authority to resolve all threshold questions, including whether this section applies, whether it is enforceable, whether a claim is within its scope, and any other question of arbitrability.

Administrator and rules. The arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, as modified by these terms; the rules and filing instructions are at adr.org. If the AAA will not administer it, you and we will select another established administrator, or, failing agreement, a court may appoint one.

Where and how. A single arbitrator decides. The arbitration is conducted by video or on written submissions where the rules allow, and otherwise in the county where you live. The arbitrator may award only the individual relief a court could award on an individual claim, is bound by these terms, and applies the governing law named below.

Fees. We will pay the arbitration filing and arbitrator fees to the extent the Consumer Arbitration Rules or applicable law require; otherwise fees are allocated as those rules provide.

Class and representative waiver. Claims may be brought only in your or our individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding, and not in the capacity of a private attorney general. The arbitrator may not consolidate the claims of more than one person and may not preside over any class or representative proceeding. This waiver is essential to the agreement to arbitrate. If it is found unenforceable as to a particular claim or a particular request for relief, that claim or request is severed and heard in a court, and every other claim stays in arbitration.

Coordinated or mass filings. If 25 or more arbitration demands raising similar claims are filed by or with the coordination or assistance of the same or coordinated counsel, you and we agree the demands will be administered in staged batches of no more than 50 at a time, with a number of bellwether cases heard first and their outcomes used to inform resolution of the remaining demands in that batch. Any applicable fee schedule and any limitation period apply to each batch as filed. This process is a material term both sides accept.

Small claims. Instead of arbitration, either of us may bring an individual claim in a small claims court if the claim qualifies and stays in that court.

Opt out. You may opt out of this Disputes and arbitration section by emailing info@applyscout.io within 30 days of first accepting these terms, with your name and account email. Opting out affects only this section and changes nothing else in these terms.

Jury waiver and confidentiality. Where this section applies, you and we waive any right to a trial by jury. The existence, content, and outcome of any arbitration are confidential, except as necessary to enforce or challenge an award, or as the law requires.

Residents of Canada. If you live in Canada, nothing in this section takes away a right you have under the consumer protection law of your province or territory. Several provinces, and Quebec in particular, do not enforce a mandatory arbitration clause or a class-action waiver in a consumer agreement; where that is so, those parts do not apply to you, you keep any right that law gives you to bring or join a claim in a court or before a consumer body, and the informal resolution step, the governing-law choice, and the rest of these terms still apply. This does not displace any non-waivable protection of the province or territory where you live.

Survival and severability. This section survives the ending of your account and these terms. If arbitration or the class waiver is unenforceable where you live, that part does not apply to you, and the rest of this section, and the rest of these terms, still stand.

Time to bring a claim

To the fullest extent the law allows, any claim arising out of or relating to the service or these terms must be commenced within one year after the claim arose; otherwise it is permanently barred.

Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. Where arbitration does not apply, the courts of Wyoming have jurisdiction. Nothing here removes a consumer protection you hold under the law of the place you live.

Changes and general

If we change these terms in a way that affects you, we will tell you by email before the change takes effect, and continuing to use the service afterwards means you accept them. We are not liable for delays or failures caused by events outside our reasonable control.

You agree to receive these terms, notices, and other communications from us electronically, at the email address on your account, and you agree that this satisfies any requirement that a communication be in writing.

These terms, together with the Refund Policy and the Privacy Policy, are the entire agreement between you and us about the service and replace anything said or written before. The sections on how we fill answers, automated submissions and your responsibility, what we do not promise, your content, liability, disputes and arbitration, and time to bring a claim survive the ending of your account.

You may not transfer your account. We may transfer these terms to a company that acquires the business. If a clause is found unenforceable, the rest continues, and failing to enforce something is not a waiver of it.
